III. General information about data processing

  1. Scope of processing of personal data
    We only process personal data of our users for the purpose of
    – Ensuring a smooth connection of the website,
    – Ensure comfortable use of our website,
    – evaluation of system security and stability, and
    – for further administrative purposes.
  2. Legal basis for the processing of personal data paragraphs
    Insofar as we obtain the consent of the data subject for the processing of personal data, Art. 6 para. 1 lit. a DSGVO serves as the legal basis.
    In the processing of personal data required for the performance of a contract to which the data subject is a party, Art. 6 para. 1 lit. b DSGVO serves as the legal basis. This also applies to processing operations that are necessary to carry out pre-contractual measures.
    Insofar as the processing of personal data is required to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 lit. c DSGVO serves as the legal basis. In the event that the vital interests of the data subject or another natural person require the processing of personal data, Article 6(1)(d) DSGVO serves as the legal basis.
    If processing is necessary to safeguard a legitimate interest of our company or a third party and if the interests, fundamental rights and freedoms of the data subject do not outweigh the first interest, Art. 6 para. 1 letter f DSGVO serves as the legal basis for processing.
  3. Data erasure and storage time
    The personal data of the person concerned will be deleted or blocked as soon as the purpose of storage ceases to apply. Furthermore, data may be stored if this has been provided for by the European or national legislator in EU regulations, laws or other provisions to which the person responsible is subject. The data will also be blocked or deleted if a storage period prescribed by the aforementioned standards expires, unless there is a need for further storage of the data for the conclusion or fulfilment of a contract.

IV. Provision of the website and creation of log files

  1. When you visit our website www.modelltechnik.com, the browser on your device automatically sends information to the server on our website. This information is temporarily stored in a so-called log file. The following information is recorded without your intervention and stored until it is automatically deleted:
    – Browser type and version
    – the operating system used and the name of your access provider
    – Website from which you visit us (Refferer-URL)
    – Website you are visiting
    – Date and time of your access
    – Your Internet Protocol (IP) address.
  2. temporary storage of your IP address by the system is required to enable delivery of the website to the user’s computer. For this the IP address of the user must remain stored for the duration of the session. The data is stored in log files to ensure the functionality of the website. In addition, the data serves us to optimize the website and to guarantee the security of our information technology systems. An evaluation of the data for marketing purposes does not take place in this context.
    The legal basis for data processing is Art. 6 Par. 1 S.1 lit. f DSGVO. Our legitimate interest follows from the aforementioned purposes for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about your person.
  3. Data is deleted as soon as it is no longer necessary to achieve the purpose for which it was collected. In the case of the collection of data for the provision of the website, this is the case when the respective session has ended. If the data is stored in log files, this is the case after seven days at the latest. Further storage is possible. In this case the IP addresses of the users are deleted or alienated, so that an assignment of the calling client is no longer possible.

V. Use of Cookies

  1. We use cookies on our website. These are small files that your browser automatically creates and that are stored on your device (laptop, tablet, smartphone, etc.) when you visit our site. Cookies do no damage to your end device, do not contain viruses, Trojans or other malware.
    Information is stored in the cookie that results in each case in connection with the specifically used terminal device. However, this does not mean that we immediately become aware of your identity.
    We use the following types of cookies:

    Cookies for analysis purposes or third party cookies are automatically deleted after the times specified by the respective provider.

VI. Google Analytics

  1. For the purpose of demand-oriented design and continuous optimization of our site, we use Google Analytics, a web analysis service provided by Google Inc. (https//www.google.de/intl/de/about/) (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, hereinafter “Google”). In this context, pseudonymised user profiles are created and cookies (see V.) are used. The information generated by the cookie about your use of this website such as

    are transferred to a Google server in the USA and stored there.

This information may also be transferred to third parties if this is required by law or if third parties process this data on behalf of the company. Under no circumstances will your IP address be merged with other data from Google.
  2. The legal basis for the use of Google Analytics is Art. 6 Par. 1 S.1 lit. f DSGVO. The above-mentioned purpose also includes the legitimate interest in the processing of the data.
  3. You can prevent the installation of cookies by setting your browser software accordingly. You can also prevent the collection of data generated by the cookie and relating to your use of the website (including your IP address) and the processing of this data by Google by downloading and installing a browser add-on (https://tools.google.com/dlpage/gaoptout?hl=en).

VII. Google Maps

  1. We use the component Google Maps of Google Inc. on our website (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, hereinafter “Google”). Each time you visit the Google Maps component, Google sets a cookie to display the site that includes the Google Maps component with user preferences and data such as

In particular, such analysis (even for unlogged-in users) is performed to provide demand-oriented advertising and to inform other users of the social network about your activities on our website.
  3. The legal basis for the use is Art. 6 Par. 1 S.1 lit. f DSGVO. The underlying purpose of an interactive route description to our company is the legitimate interest within the meaning of the DSGVO.
  4. You can prevent this processing of your data by disabling the Google Maps service and preventing the transfer of data to Google. To do this, you must deactivate the Java script function in your browser. However, we would like to point out that in this case not all functions of this website may be fully usable.

We recommend that you log out regularly after using your Google account, as this way you can avoid being assigned to your profile at the provider Google.

You also have a right to object to the creation of these user profiles, whereby you must contact Google to exercise this right. We have no influence on the data collected and data processing processes at Google.

VIII. reCAPTCHA

  1. To protect the contact form on our site – for more information see XII. on our website, we use the service reCAPTCHA of Google Inc (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA, hereinafter “Google”). By using this service it can be distinguished whether the corresponding input is of human origin or is abusive through automated machine processing. In the process

    – Presentation instructions and scripts
    – Input behaviour of the user
    – mouse movements
    in the reCAPTCHA checkbox area to Google.
    Google uses the information obtained in this way and above all to digitise books and other printed matter and to optimise services such as Google Streetview and Google Maps (e.g. house number and street name recognition).
    The IP address transmitted within the scope of reCAPTCHA will not be merged with other Google data unless you are logged in to your Google account at the time you use the reCAP-TCHA-plug-in.
  2. The legal basis for the use is Art. 6 Par. 1 S. 1 lit. f DSGVO. The purpose described above, to maintain a user-friendly form for contacting us on our website, is to be regarded as a legitimate interest within the meaning of the regulation.

  3. You can prevent this transmission and storage of data about you and your behaviour on our website by Google if you log out of Google before you visit our website or use the reCAPTCHA plug-in.

The information obtained through the use of the reCAPTCHA service will otherwise be processed in accordance with the Google Terms of Use (https://www.google.com/intl/de/policies/privacy/).

IX. YouTube

  1. We also use components (videos) from YouTube (LLC901 Cherry Avenue, 94066 St Bruno, CA, USA, a company of Google Inc., hereinafter referred to as YouTube) on our website. Here we use the option “extended data protection mode” provided by YouTube.
    When you access a page that has an embedded video, it connects to the YouTube servers and displays the content on the website by notifying your browser. In “extended data protection mode”, only data is transmitted to the YouTube server, especially which websites you have visited when you watch the video. If you are logged in to YouTube at the same time, this information will be associated with your YouTube account. You can prevent this processing of your data by logging out of your member account before visiting our website.
  2. We use such plug-ins from YouTube on our website to make our company better known about them.
    YouTube stores your data as user profiles and uses them for purposes of advertising, market research and/or demand-oriented design of its website. Such evaluation takes place in particular (even for unlogged-in users) to provide demand-oriented advertising and to inform other users of the social network about their activities on our website.
  3. The legal basis for the use is Art. 6 Par. 1 S.1 lit. f DSGVO. The legitimate interest within the meaning of this provision is to be seen in the previously described advertising purpose.
  4. You have a right to object to the creation of user profiles, whereby you must contact YouTube to exercise this right.

X. Use of 1 & 1-tools

Our website is hosted on 1 & 1. The company 1 & 1 Internet SE (Elgendorfer Straße 57, 56410 Montabaur) uses so-called LOGs, which are stored on our web server and enable an analysis of the use of our website. These LOGs enable us to evaluate information, e.g. the flow of visitors to our website. The LOGs are deleted after about six months. Personal data is not stored in this context and does not allow any conclusions to be drawn about your person. In this respect, the data is processed on the basis of Art. 6 Para. 1 S.1 lit. f DSGVO and must be regarded as in our legitimate interest for the aforementioned purpose.

XI. bbclone

For a better overview of our website we use bbclone from the company bbclone © the bbclone Team released under the terms of the GPL (bbclone.de). So-called LOGs and cookies, which are stored on our web server and enable an analysis of the use of our website, are used. These LOGs enable us to evaluate information, e.g. the flow of visitors to our site. All data is combined and then deleted. Personal data will not be passed on to third parties in this

context and do not allow any conclusions to be drawn about your person. The legal basis for the processing of the data is Art. 6 Para. 1 S.1 lit. f DSGVO and our legitimate interest lies in the purpose described above.

XII. contact form and e-mail contact

  1. Our website has a contact form which can be used for electronic contact. If this was the case, the data entered in the input mask will be transmitted to us and saved. This is the following data:
    – your name
    – your email address
    – Your message At the time the message is sent, the following data is also stored:
    – Your IP address
    – Date and time
    Alternatively, you can contact us via the e-mail address provided. In this case, your personal data transmitted with the e-mail will be stored.
    The contact form is sent unencrypted, i.e. like a normal e-mail. Your data will not be passed on to third parties. The data collected in connection with contacting us is not compared with data that may be collected by other components of our website.
  2. The processing of the personal data from the input mask/e-mail serves us only for the treatment of the establishment of contact. The other personal data processed during the sender process serve to prevent misuse of the contact form and to guarantee the security of our information technology systems.
  3. The legal basis for the processing of data is Art. 6 para. 1 sentence 1 lit. a DSGVO. If the aim of establishing contact is to conclude a contract, Art. 6 para. 1 sentence 1 lit. b DSGVO is also the legal basis for processing.
  4. The data will be deleted as soon as it is no longer necessary to achieve the purpose for which it was collected. For the personal data from the input mask of the contact form and those that were sent by e-mail, this is the case when the respective conversation with you is finished. The conversation is terminated when it can be inferred from the circumstances that the facts in question have been finally clarified.
    Should a contract be concluded, the data will also be stored until the expiry of the statutory retention periods and then deleted, unless we are obliged by law, in particular by tax and commercial law storage and documentation obligations to a longer storage or you have consented to a further storage in accordance with Art. 6 Para. 1 S.1 lit. a DSGVO.
    The additional personal data collected during the sending process will be deleted after a period of seven days at the latest.
  5. You have the possibility to revoke your consent to the processing of your personal data at any time. If you contact us by e-mail, you can object to the storage of your personal data at any time. In such a case, however, the conversation cannot be continued. The revocation/rejection can be made at any time by e-mail or post to the responsible body (cf. under I.). All personal data stored in the course of contacting us will be deleted in this case.

XIII. Google+/Facebook

  1. We currently use social media plug-ins for Facebook, YouTube and Google+. We use the “2-click solution”, i.e. when you visit our site, no personal data will be forwarded to the providers of the plug-ins. We offer you the possibility to communicate directly with the provider of the plug-in via the respective button. Only if you click on the marked field and thereby activate it, the plug-in provider contains the information that you have accessed the corresponding website of our online offer. In addition, the data mentioned under IV. of this declaration will be transmitted.
    The data is transferred regardless of whether you have an account with the plug-in provider and are logged in there. If you are logged in with the plug-in provider, your data collected with us will be directly assigned to your existing account with the plug-in provider. If you confirm the activated button and, for example, link the page, the plug-in provider will also save this information in your user account and inform your contacts publicly. In the case of Facebook, according to the provider in Germany, the IP address is anonymized immediately after collection.

The respective plug-in provider stores the data collected about you as user profiles and uses these for the purposes of advertising, market research and/or demand-oriented design of its website.   3. The legal basis for the use of the plug-in is Art. 6 Par. 1 S.1 lit. f DSGVO. The aforementioned advertising purpose is our legitimate interest within the meaning of the regulation.

XIV. rights of affected persons

You have the right:

  • in accordance with Art. 15 DSGVO to request information about your personal data processed by us. In particular, you may request information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of rectification, deletion, restriction of processing or opposition, the existence of a right of appeal, the origin of your data, if not collected by us, and the existence of automated decision-making, including profiling, and, if applicable, meaningful information about their details,
  • in accordance with Art. 16 DSGVO to demand the correction of incorrect or complete personal data stored by us without undue delay,
  • to request the deletion of your personal data stored by us in accordance with Art. 17 DSGVO, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims,
  • in accordance with Art. 18 DSGVO to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful, but you refuse its deletion and we no longer need the data, but you need it to assert, exercise or defend legal claims or you have filed an objection to the processing in accordance with Art. 21 DSGVO,
  • pursuant to Art. 20 DSGVO to receive your personal data that you have provided to us in a structured, current and machine-readable format or to obtain the transmission to another person responsible;
  • in accordance with Art. 7 Para. 3 DSGVO to revoke your consent to us at any time. As a result, we are no longer allowed to continue processing data based on this consent in the future;
  • under Art. 77 DSGVO to a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters.

XV. right of objection

If your personal data are processed on the basis of legitimate interests pursuant to Art. 6 para. 1 sentence 1 lit. f DSGVO, you have the right to object to the processing of your personal data pursuant to Art. 21 DSGVO, provided that there are reasons for this which arise from your particular situation or the objection to direct advertising is directed. XVI. right to revoke consent under data protection law

According to art. 7 para. 3 DSGVO you have the right to revoke your consent to us at any time. As a result, we are no longer allowed to continue the data processing based on this consent in the future. The legality of the processing carried out on the basis of the consent until revocation is not affected by this.

XVII. data security

We also use suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties.
